Terms and Conditions - Villa Jade Saint-Barthélemy
ARTICLE 1 - OCCUPANCY CONDITIONS
Unless otherwise stated, the maximum number of people per room is two.
If a group shows up as being made up of more people than it should actually be, payment must be made immediately for the extra people, it being specified here that in no case may the number of people occupying the property exceed the maximum occupancy of the property.
Children under the age of 2 who sleep in a crib are not counted but must be mentioned to Tropical Villas Rental at the time of booking.
The Tenant and other occupants of the property, for whom the Tenant is considered responsible, guarantee to behave in an acceptable and decent manner and undertake to respect the rented premises and its equipment, to return them in the same condition and not to cause any nuisance whatsoever to the neighborhood. Sub-letting is forbidden.
The Tenant agrees to allow free access to the property at all times to the person responsible for the maintenance and operation of the villa (the "Manager").
ARTICLE 2 - POOL SAFETY
Where applicable, the swimming pool in the rented premises is equipped with a safety system in accordance with articles 1281 and 1282 of the French Construction Code.
The Tenant and other occupants of the property therefore undertake to leave this alarm in operation throughout their stay.
They also acknowledge that they are fully aware that, even when in operation, the alarm is in no way a substitute for the vigilance they must exercise over their child(ren) or any other person(s).
ARTICLE 3 - ARRIVAL AND DEPARTURE TIMES
Arrival at the property is from 3 p.m., departure from the property before 11 a.m. (unless otherwise agreed with Tropical Villas Rental).
ARTICLE 4 - BOOKING AND CANCELLATION CONDITIONS
The Tenant undertakes to pay a deposit equal to 30% of the rent at the time of booking.
The reservation will be confirmed only after Tropical Villas Rental has received the deposit. The balance must be paid 60 days before the arrival date.
For bookings made less than 60 days before the arrival date, the Tenant must pay the full cost of the rental at the time of booking.
No reservation will be considered confirmed until Tropical Villas Rental has received the deposit and signed the quotation and rental conditions. (in the case of confirmation, each page of the terms and conditions must be initialled by the customer and signed on the last page).
In the event of non-receipt of the balance 60 days before the arrival date, Tropical Villas Rental reserves the right to cancel the reservation. This cancellation will result in the loss of the deposit by the Tenant.
Cancellation policy :
- In the event of cancellation 91 days or more before the arrival date, no penalty will be applied to the renter, who will be reimbursed the full amount of the deposit, less reimbursement costs.
- In the event of cancellation between 90 days and 61 days before the arrival date, Tropical Villas Rental will retain the 30% deposit.
- In the event of cancellation 60 days or less before the arrival date, Tropical Villas Rental will retain the full amount of the rental.
Any modification of the rental conditions by the customer (no-show, early departure, change in the number of people staying in the villa, etc.), whatever the cause, will be the exclusive responsibility of the customer, who will not be entitled to any compensation in this respect.
In the event of non-arrival, the full amount of the stay will be charged.
Please note that if the tenant does not show up on the confirmed arrival date, this will be considered as a cancellation of the entire stay and Tropical Villas Rental will be free to re-let the villa.
- SPECIAL CASES - End-of-year celebrations
The Tenant agrees to pay a deposit equal to 50% of the rent at the time of booking.
The balance must be paid 90 days before the arrival date.
No reservation will be considered confirmed until Tropical Villas Rental has received the deposit and signed the quotation and rental conditions. (in the case of confirmation, each page of the terms and conditions must be initialled by the customer and signed on the last page).
All requests for cancellation must be made in writing to Tropical Villas Rental.
For bookings made less than 90 days before the arrival date, the Tenant must pay the full cost of the rental at the time of booking.
In the event of non-receipt of the balance 90 days before the arrival date, Tropical Villas Rental reserves the right to cancel the reservation.
This cancellation will result in the loss of the deposit by the Tenant.
If the Tenant cancels ninety-one (91) days or more prior to arrival, no penalty will be applied to the Tenant, who will be reimbursed the full amount of the deposit, less any reimbursement costs.
If the Tenant cancels between ninety (90) days and sixty-one (61) days prior to arrival: the customer will be charged a cancellation fee of fifty percent (50%) of the rental price.
If the Tenant cancels sixty (60) days or less before arrival: the customer will be charged a cancellation fee of one hundred percent (100%) of the rental price.
The full amount of the stay will be due in the event of cancellation, no-show or changes to the reservation (change in the number of people, early departure, etc.).
ARTICLE 5 - SECURITY DEPOSIT
Tropical Villas Rental will take the Tenant's credit card details to cover any damage that may occur during their stay at the property.
In the event of damage to the property caused by the Tenant or other occupants during their stay, the Tenant expressly authorizes Tropical Villas Rental to charge this credit card to cover the repairs incurred, plus a 5% processing fee.
If the Tenant finds any damage to the property on arrival, he/she must notify Tropical Villas Rental immediately.
ARTICLE 6 - CLEANING
Unless otherwise stated in the villa description, cleaning is carried out every day except Sundays and public holidays. It is included in the rent.
IMPORTANT: The cleaning service does not include the cleaning of personal belongings, which is on request and subject to a charge.
ARTICLE 7 - ACCOMMODATION RATES
Accommodation rates are quoted per night, in euros, or dollars (VAT not applicable in St. Barthélemy), for one or two people per room.
A minimum stay of 7 nights is required, shorter stays on request.
Each stay including Christmas Day or New Year's Day will be charged at the holiday rate and for a minimum period of 14 nights.
The minimum length of stay including Thanksgiving Day may vary.
Rates are subject to change without notice.
ARTICLE 8 - LIABILITY FOR PERSONAL EFFECTS AND PROPERTY
The Tenant and other occupants of the property are entirely responsible for their personal belongings.
Valuables must be placed in the safes provided.
Neither Tropical Villas Rental nor the owner can be held responsible for any loss, damage or theft of these objects and/or personal effects.
ARTICLE 9 - INSURANCE
We recommend that Renters take out cancellation insurance to cover all risks relating to their trip (flight cancellation, delays, loss of luggage, etc.).
Neither Tropical Villas Renta nor the owner can be held responsible for any problems relating to the travel of the Tenant or other occupants of the property such as those mentioned above.
ARTICLE 10 - VISA REQUIREMENTS
It is the customer's responsibility to verify whether or not a visa is required.
It is the customer's responsibility to check with the French Embassy for the latest law regarding visa requirements.
Please note that no refunds will be made and the entire stay will be charged if Guests are not allowed to enter the island.
ARTICLE 11 - CLAIMS AND DISPUTES
If the Tenant encounters a problem in the villa during his/her stay, he/she must notify Tropical Villas Rental immediately.
Only complaints recorded by Tropical Villas Rental during the Tenant's stay will be taken into consideration.
The Tenant agrees that this contract shall be governed by and construed in accordance with French law with respect to any claim against Tropical Villas Rental.
In the event of a dispute, the competent court is the Tribunal de Basse Terre (Guadeloupe).
